1. Who We Are, We are Tournament Finder

1.1 Tournament Finder Services.

Tournament Finder is a tournament and tournament merchandise listing and registration platform with a mission to help you find new and exciting tournaments and then make the registration as simple as possible.

1.2 Who’s Who.

When this Privacy Policy uses the term “Organiser” we mean Tournament creators and merchandisers using the Services to create Tournaments for consumers using our Services (a) to consume information about, or attend, Tournaments (“Consumers”), or (b) for any other reason. Organisers, Consumers and third parties using our Services are all referred to in these Terms collectively as “Users”, “you” or “your”.

Tournament Finder Limited is a London based business that is registered with Companies House, the United Kingdom’s registrar of companies.

2. Our Privacy Statement.

2.1 Application.

Our policy with respect to information that relates to or can be associated with a person and/or could be used to attain the identity of a person (“Personal Data”) that is collected through the Services or from Users. Personal Data is taken very seriously at Tournament Finder and this is the reason we have created this Privacy Policy. This Privacy Policy has very important information with regards to your personal data and other information you may find useful.

Any data or information that can not be related to a person and/or can not be used to identify a person will be called within this Privacy Policy “Non-Personal Data”. We may collect Non-Personal Data When you interact with the Services. Non-Personal Data does not have the same limitations and requirements with regards to the collection, use, disclosure, transfer and storage/retention as set out in this Privacy Policy as that which is applied to Personal Data.

3. Personal Data That We Collect.

We may collect Personal Data when you interact or use the Service. This may be for our own use or on behalf of an Organiser to ensure they can run a tournament or provide you with your desired merchandise. This distinction is important for EU data protection as outlined in section 16.

3.1 All Users.

The Information you provide: We collect Personal Data from all users when you voluntarily provide such information to the Services e.g. when you register or browse the website.

When you submit Personal Data to us, we may associate other Non-Personal Data with your Personal Data, we will then treat any such combined data as your Personal Data.

3.2 Organisers.

As an Organiser, we will collect additional Personal Data from you.

Information you provide to us: Information we obtain from other sources: We may also collect or receive Personal Data from third party sources, such as third party websites. Additionally, we may use information you have shared with other Tournament Finder Limited Assets.

3.3 Consumers.

Information you provide via Tournament Finder Properties or Applications: If you register for a paid event, you will provide financial information (e.g., your credit card number and expiration date, billing address, etc.) some of which may constitute Personal Data. Tournament Finder does not collect this data directly since all consumer transactions are handled by our payment partners, but may receive the data from the payment partner. Tournament Finder does not control an Organiser’s registration process nor the Personal Data that they collect. Personal Data collected on behalf of Organisers is provided to the Organiser of the applicable event in accordance with “How We Disclose and Transfer Your Personal Data: Organisers” below.

Information we obtain from other sources: We may also collect or receive Personal Data from third party sources, such as Organisers, other Consumers, social media or other third party integrations, our payment processing partners or other third parties.

4. How We Use Your Personal Data.

We use our Privacy Policy to ensure that we are consistent in the way that we collect and use Personal Data. The guideline we govern ourselves by are as follows:

4.1 Specific Reason.

We only use the Personal Data you provide for the use you provided it for i.e., if you contact us by email then we will use your email address to reply to your question.

4.2 Access and Use.

If we require Personal Data to use a Service or functionality then upon receiving the data we will provide you with that Service or functionality, in addition, we may also use the data to ensure that the Services you use perform optimally and you are able to use them optimally.

4.3 Internal Business Purposes.

Personal Data you provide may be used for internal business purposes to improve the Services or ensure their functionality. Such as but without limitation providing you with customer service and enforcing our Terms of Service.

4.4 Tournament Finder Marketing Communications.

If you have set your preferences to allow it, we may contact you with the use of your Personal Data for the purposes of marketing and advertising. Consult the “Opt Out from Electronic Communications” provided below on how to opt out of Tournament Finder Marketing Communications.

4.5 Organiser Emails.

Currently emails are automatically sent on the Organisers behalf to inform you of your registration status. The email Services on the site are expected to evolve but should any Service enable an Organiser to send more than the essential emails, such as, those that inform you of your registration or the cancellation of an event, then an opt out option will be provided as outlined in the “Opt Out for Electronic Communications” below.

4.6 Other Purposes.

If we intend to use any Personal Data in any manner that is not consistent with this Privacy Policy, You will be informed prior to or at the time that the Personal Data is collected or we will obtain your consent subsequent to any collection of Personal Data that will be used in a manner that is not consistent with the Privacy Policy.

4.7 Aggregated Personal Data.

We may conduct research on our customer demographics, interests and behaviour based on Personal Data and other information that we have collected to try and improve our Services. This data will be aggregated and thus will remove any possibility that it can identify an individual. Once the Personal Data is in aggregated form, for purposes of this Privacy Policy, it becomes Non-Personal Data.

5. How We Disclose And Transfer Your Personal Data.

5.1 No Sale.

We are not in the business of selling your Personal Data to the highest bidder. We consider this information to be a vital part of our relationship with you. We do however hope to form relationships with partners such as sports federations and associations such as World Rugby. In these circumstances we may disclose, transfer or share your Non-Personal Data including Aggregated Personal Data without further notice to you, as set forth below

5.2 Business Transfers.

We like who we are but we can’t predict the future, therefore we have to consider the possibility that one day we may have to buy or sell businesses or assets. If there is a corporate sale, merger, dissolution, reorganisation, or something similar where Personal Data may be part of the assets included in the deal. You acknowledge and agree that any successor to or acquirer of Tournament Finder (or the assets of) will continue to have the right to use the Personal Data as well as any other information gained in accordance with the terms of the Tournament Finder Privacy Policy.

5.3 Parent Companies, Subsidiaries and Affiliates.

Should we become part of a larger organisation, you acknowledge and agree that we may share your Personal Data with our parent companies, subsidiaries and/or affiliates for purposes that are consistent with this Privacy Policy. Our parent companies, subsidiaries and affiliates will be bound to maintain that Personal Data in line with this Privacy Policy.

5.4 Agents, Consultants and Service Providers.

To provide you with a Service that we are proud to offer you, we must work with partners and share information with them. You therefore acknowledge and agree that we may share your Personal Data with our service providers and contractors who process Personal Data on behalf of Tournament Finder to perform certain business-related functions. These companies include by are not limited to our marketing agencies, database service providers, backup and disaster recovery service providers, email service providers.

5.5 Organisers.

When you purchase tickets, register for or donate to a tournament through the tournament page, we provide the Personal Data entered on the applicable tournament to the Organisers of such tournament. In some instances, an Organiser may appoint a third party, which may or may not be affiliated with the Organiser, to create a tournament page on its behalf (we call these third parties (“Third-Party Organisers”). For example, and without limitation, a Rugby Club (the Organiser) may allow third party promoters (the Third-Party Organisers) to create tournaments that will be hosted at the Organiser’s club using its Tournament Finder account. In that case, the Third-Party Organiser may obtain your Personal Data via the Organisers Tournament page. We are not responsible for the actions of these Organisers, or their Third-Party Organisers, with respect to your Personal Data. It is therefore important that you review any application policies that are outlined by the Organisers and/or their appointed Third-Party Organisers before providing Personal Data.

5.6 Legal Requirements.

When it is required by law, we may disclose your Personal Data in order to (for example) respond to a subpoena or request from law enforcement, a government agency or a court (this includes in response to any public authorities in order to meet national security or law enforcement requirements), or in the good faith belief that that sharing is required to ensure we (i) protect and/or defend legal rights, interests or property or that of third parties, (ii) comply with a legal obligation, (iii) act in an urgent circumstance in order to protect the personal safety of our Users or the public (iv) prevent our Services or investigate any possible wrongdoing that is in connection with the Services, or (v) protect against legal liability.

6. How We Store Your Personal Data.

Personal Data may be stored by Us or the information may be stored by third parties that we have transferred the data to, in accordance with the Privacy Policy. To help to ensure the security of your data we only take what we believe is necessary and we take what we believe to be reasonable steps to protect all the Personal Data that we collect via our Services from misuse, loss, unauthorised use, inadvertent disclosure, access, alteration and destruction. However, it is also the case that no matter what precautions taken, no network, database, server, internet transmission, or even email transmission can ever be fully secure and error free. It is therefore important that you as a User of the Services take care with regards to what information you share or send to us on the Services.

7. How You Can Access, Update, Correct or Delete Your Personal Data.

if you so wish, you may request access to some of your Personal Data being stored by us. You can also ask us to correct, update or delete any inaccurate Personal Data that is on our Services.

If you are a registered User, you can exercise these rights by logging in to our website and visiting your ‘Account Settings’. The ‘Account Settings’ can be found by loggin into your account and selecting ‘settings’ on your dashboard. Some settings for your account can be changed in ‘edit account’, this is found by selecting the little human logo at the bottom of the dashboard menu. Both registered and unregistered Users may also exercise these rights by contacting us directly by email [email protected].

You accept and acknowledge that if a Consumer initiates a data deletion request, Tournament Finder is authorised to delete or anonymise their Personal Data from the Services even if that means removing its availability to the Organiser through the Services. However, if you are a Consumer, you understand that even if Tournament Finder removes or anonymises your Personal Data in response to your request to do so, or pursuant to this Policy, your Personal Data may still be available to an Organiser’s via their own databases if transmitted to the Organiser prior to Tournament Finder receiving or taking action on any deletion or anonymisation activity.

Any request that is received that is within the applicable law will be considered

8. How Long We Retain Your Personal Data.

Your Personal Data may be retained by Tournament Finder for as long as you are registered on our Services. You may remove your registration and close your account by contacting us at [email protected]. However, we must abide by the applicable laws including those for legal, tax and regulatory, to ensure we are a legitimate and lawful business we may need to keep Personal Data on backup and archival media for an additional period after a Consumer has requested we delete it.

9. Cookies, Pixels Tags, Local Shared Objects, Web Storage And Similar Technologies.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

9.1 Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

9.2 Who we share your data with

If you request a password reset, your IP address will be included in the reset email.

9.3 How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

9.4 What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

9.5 Where we send your data

Visitor comments may be checked through an automated spam detection service.

9.6 Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

9.7 Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

10. Your Choices.

You have the following options with regards to your Personal Data:

10.1 Limit the Personal Data You Provide.

You can browse the Services without providing any Personal Data. Your browser may request that you provide your location, this will help to ensure you are shown relevant information for your location first but will not change the totality of the information you can see. However, to use additional functionality of the site beyond browsing you will need to provide additional information, the information required will be dependent upon what you would like to do on the Services, i.e. the Personal Data required for an Organiser will differ from other Consumers.

10.2 Opt Out from Electronic Communications.

(a) Tournament Finder Marketing Communications.

Dependent upon the marketing preferences you choose, Tournament Finder may send you electronic communications that market or advertise the Services or tournaments on the Services, to the extent you have registered for the Services or registration to a tournament listed on the Services. You can also “opt out” of receiving these electronic communications by emailing us at [email protected].

(b) Organiser Initiated Communications.

Currently, emails are sent to Consumers that register for tournaments automatically. These are essential emails that are required to inform you that your registration was successful (explained below in (c)) and therefore the only way to prevent them is to remove yourself from the services and/or reframe from entering or creating tournaments. We are currently reviewing the communication services and therefore this section of the Privacy Policy is expected to be updated as these changes are made.

(c) Transactional or Responsive Communications.

There are electronic communications from Tournament Finder that are responsive to your requests. The most common of which is, if you are a Consumer, we must email you your registration information on behalf of the Organiser when you purchase such a registration. You can stop receiving any and all types of emails by contacting us at [email protected]. By electing to stop receiving all electronic communications from you will no longer receive any updates on tournaments you have created (including pay-out issues) or on tournaments you are registered to attend (including emails with your tickets). Since this will most likely create an additional burden for you and those that are either Consumers or Organisers of Tournaments that you organise of wish to attend, we do not recommend that you do this unless you plan to no longer use the Services, are not currently registered for a tournament, are not currently organising a tournament and will have no need to receive further communications from us or through our system.

(e) Retention.

A unsubscribe request may take up to forty-eight (48) hours for us to process. As previously outlined, even after you opt out of all electronic communications, we may retain your Personal Data in accordance with this Privacy Policy, however, we will no longer use it to contact you. Additionally, we do not control the data kept by Organisers and therefore Organisers that have received your Personal Data as outlined in the Privacy Policy may still us that Personal Data in accordance with their privacy policies, however, they may not use our Services to do so.

10.3 Do Not Track.

We currently do not participate in any “Do Not Track” frameworks the options regarding data are those that are outlined above only.

11. Exclusions.

11.1 Personal Data Provided to Others.

This Privacy Policy does not apply to any Personal Data that you make public or share with others, this includes Personal data that you provide to another User or visitor through the Services or through any other means, and includes to Organisers on tournament pages or information that you may have posted to any public areas of the Services.

11.2 Third Party Links.

The Tournament finder Services may contain links to other website that we do not operate or control (“third Party Sites”) however, This Privacy Policy only applies to the Tournament Finder Services themselves and not the Third Party Sites. Any links on the Services do not imply that we endorse or have in any way reviewed the Third Party Site. If you choose to use Services that are not Tournament Finder Services then we suggest you consult the Terms of Service of those Services.

12. Children – Children’s Online Privacy Protection Act

Tournament Finder is intended for the use of Adults of sound mind and judgment. Personal Data from children under the age of thirteen (13) is not knowingly collected. If you are under the age of thirteen (13) do not use any of the services without an adult and please do not submit any Personal Data through the Services. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy. Please instruct your children to never provide Personal Data through the Services. If you have reason to believe that a child under the age of 13 has provided Personal Data to us through the Services, please contact us and we will work to delete that information from our databases.

13. International Privacy Laws.

Visitors to the Services from outside the United Kingdom, note that you are sending information (including Personal Data) to our servers that are located within the United Kingdom. That information may then be transferred out of the United Kingdom to other countries other than the United Kingdom and your country of residence. No matter which country the data is stored, collected or used in your Personal Data will always and at all times continue to be governed by this Privacy Policy.

14. Changes To This Privacy Policy.

We are always looking to improve and extend our Services to provide you with the best product we can. Since the Services are expected to change over time it may be necessary at times to make changes to this Privacy Policy therefore the following must, reserve the right, in our sole discretion to modify and/or update this Privacy Policy as and when we feel it is fit to do so (collectively “Policy Changes”). When Policy Changes to this Privacy Policy are made they will be posted on the Services with an modified date next to the “updated” comment near the start of the modified Privacy Policy. If it chooses but it may not choose, Tournament Finder may provide you with an additional notice of Policy Changes to the Privacy Policy via an email or via Service notifications. Any Policy Changes made will be in effect thirty (30) days after the date stated next to “updated” in the Privacy Policy or in extraordinary cases a date communicated in any other notice to you.

Before you provide any Personal Data we recommend that you review this Privacy policy and you continue to review this privacy Policy of a regular periodic bases. This Privacy Policy was last updated on the date indicated near the start of this document. Your continued use of Tournament Finder Services after Policy Changes constitutes acceptance to any modifications that were made. If you find any of the Policy Changes made are not acceptable to you then you should cease using the Services in any way including but not limited to accessing and browsing the Services.

16. EEA, SWITZERLAND AND UK ONLY

The EU General Data Protection Regulation (GDPR)

A data privacy law known as the EU General Data Protection Regulation (or the “GDPR”) requires Tournament Finder and Organisers using the Service to provide Users with more information about the processing of their Personal Data.

The GDPR requires Tournament Finder to tell you about the legal ground we’re relying on to process any of your Personal Data. We out lined the purposes for which we process your personal data in Section 4 above and the legal grounds for us to do this are:

• it is necessary for our contractual relationship;
• you provided your consent;
• the processing is necessary for us to comply with our legal or regulatory obligations; and/or
• it is in our legitimate interest to process this information as a tournament organising and registration platform (for example, we need to do it to protect the security and integrity of our systems or it is required to provide you with customer service, etc.).

Transfers of Personal Data

Tournament Finder aspires to be a global company and therefore data on its Services, including your Personal Data, may need to be transferred between jurisdictions. This may be between our own Services or to third parties that we work with, who may be located outside the UK or your country of residence and whom may have less data protection laws or laws that are less strict compared to those of the UK

As Tournament Finder is a global company, we may need to transfer your Personal Data outside of the country from which it was originally provided. This may be intra-group or to third parties that we work with who may be located in jurisdictions outside the EEA, Switzerland and the UK which have no data protection laws or laws that are less strict compared with those in Europe.

Whenever we transfer Personal Data the UK, we take legally required steps to make sure that appropriate safeguards are in place to protect your Personal Data. These steps may change as the Brexit process continues to unfold.

As previously outlined we retain Personal Data while it is necessary to do so in order to provide you with access to the Services, or for us to comply with legal obligations, resolving disputes and enforcing our Terms of Service or other agreements

You have the legal right to request a copy of the Personal Data; request that we rectify, restrict or delete your Personal Data; object to profiling; and unsubscribe from marketing communications. Tournament Finder will abide by all local laws, regulations, and obligations and therefore there may be cases where we are not legally required, obliged, or able to comply with your request.

Tournament Finder as a data controller and a data processor

As out lined in EU data protection law an organisations that process Personal Data for their own purposes are known as “data controllers” and organisations that process personal data on behalf of other organisations are known as “data processors”. Questions or complaint about how your Personal Data is handled, should always be directed to the relevant data controller because they are the party who primarily responsible for your Personal Data.

Depending on the Service you use and how you use it Tournament Finder may act as either a data controller or a data processor of your Personal Data. If you are unsure please contact us and we will direct you to the appropriate party.

We share information with third parties who help us provide our orders and store services to you; for example the tournament organiser or kit vendor.

Payments

We accept payments through PayPal. When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information.

We collect information about you during the checkout process on our store.

What we collect and store

While you visit our site, we’ll track:

Stores you’ve viewed: we’ll use this to, for example, show you vendor stores you’ve recently viewed
Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping
Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order!

We’ll also use cookies to keep track of cart contents while you’re browsing our site.

We share information with third parties who help us provide our orders and store services to you; for example the tournament organisers and kit suppliers.

Modules

Dokan has premium modules that perform specific and special purpose tasks. Each of the modules collect additional information. Also third party extensions and integrations collect data that is applicable to the each of their individual privacy policy.

Akismet functionality

We collect information about visitors who comment on Sites that use our Akismet Anti-spam service. The information we collect depends on how the User sets up Akismet for the Site, but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).
