Our Mission is to stimulate the growth of amateur sport by helping local clubs and community groups hold tournaments. The first part of this mission is to provide a global marketplace for tournaments and sports activities. Tournament Finder understands the importance of providing a clean and clear platform where our users have full disclosure of the terms of their use, the purchase they make and where those terms meet certain minimum requirements. For that reason, Tournament Finder has created the following requirements governing the refund policies of organisers of paid tournaments (“Organisers”) hosted on Tournament Finder (the “Refund Policy Requirements”).
The rights and obligations contained in these Refund Policy Requirements are in addition to and are incorporated into the Terms of Service by reference.
1.1 Minimum Requirements.
From the discussions we have had with tournaments it was made clear to us that refund polices vary between types and size of tournaments. We therefore provide some flexibility that enables the Organiser or vendor to post their own terms for their own tournaments, but they must still follow the following minimum requirements:
(a) You must have posted the Refund policy on the tournament page prior to any payment received and the policy must be left on the page unchanged until we remove the page;
(b) where necessary, a policy of “no refunds” is permissible but this policy must be clearly presented on the tournament page and the policy must otherwise comply with our other minimum requirements;
(c) A refund or other make good for failure to provide the advertised goods and services (such as event cancellation) must be provided by all refund policies including a “no refund” policy;
(d) All appropriate laws, rules, regulations and guidelines should be followed by refund policies including all requirements of necessary payment frameworks as defined in the Merchant Agreement;
(e) Specific instructions must be provided within the refund policy that informs the consumer on how, when, and where to submit a refund request;
(f) Refund policies must set out a specific time frame within which refund requests will be responded to;
(g) Only refund policies that are otherwise fair and reasonable will be recognised.
Tournament Finder may (but is not obliged to), In the event that a refund policy has not been posted or the policy does not meet the minimum requirements outlined above, modify or remove any refund policy so that it meets the minimum requirements outlined. Tournament Finder may choose to apply changes to the posted refund policy on the site or retroactively apply the changes if/ when there is a dispute or refund request.
1.2 Refund Process.
To make a refund request Tournament Finder instructs Consumers to contact the Organiser of the Tournament or merchandise vendor directly as outlined by the Organiser’s refund policy. Therefore, to use the Services the organiser and vendors must agree to the following:
The Organiser and/or vendor agrees to follow the minimum requirements defined in section 1.1 above with regards to administering its refund policy and that these minimum requirements take precedence over any additional refund policy defined by the Organiser.
The Organiser agrees that they have sevens (7) days to respond to a Consumers refund request by either refunding or denying the request, after which Tournament Finder may execute the refund on the behalf of the Organiser and the Organiser will repay any costs incurred by Tournament Finder.
1.3 Tournament Finder Review.
If under the applicable refund policy and the minimum requirements outlined above, the Consumer believes that a refund is due and the Organiser has failed to honour it, the Consumer may request Tournament Finder to initiate the refund by contacting us at [email protected] and including refund in the subject line. Tournament Finder will try to complete the review within thirty (30) days of receiving the request from the Consumer. However, the Consumer should note that Tournament Finder does not have control of the funds and Tournament Finder will need the provider of the facilitated payment method to cooperate in order to obtain a refund, which may not happen. All determinations by Tournament Finder with respect to these Refund Policy Requirements, including without limitation the orders to be refunded and the size of any refund, shall be final and binding on both Organiser and Consumer.
The Refund Policy Requirements presented in this document are not a guarantee that refunds will always be issued in any given situation nor are they intended to be or constitute any form of insurance of the performance or guarantee of performance of any Organiser.
